1. Sponsor

This sweepstakes (“Sweepstakes”) is sponsored by Noms Magazine (“Sponsor”).

2. Eligibility

The Sweepstakes is open only to legal residents of Canada (excluding Quebec) who are at least the age of majority in their province or territory of residence at the time of entry. Employees of Sponsor and its affiliated companies, and their immediate families, are not eligible to enter. This Sweepstakes is subject to all federal, state, and local laws and regulations and is void where prohibited by law.

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding.

4. Sweepstakes Period

The Sweepstakes begins on March 29 2024 and ends on May. 10, 2024 as the “Sweepstakes Period”. Entries beyond this period will not be eligible. 

5. How to Enter

There are three methods of entry:

a) Festival Missions: Entrants can enter the Sweepstakes by completing missions at the Noms Magazine Vancouver Cherry Blossom Food Festival website. Each completed mission, when shared on Instagram or TikTok with the correct tagging and hashtag as per the mission instructions, will earn the participant one entry into the Festival Missions Sweepstakes.

b) Festival Passport: Entrants can enter the Sweepstakes by collecting stickers on their Festival Passport. For every four (4) points collected, participants will earn one entry into the tiered Festival Passport Sweepstakes. Three (3), six (6), and nine (9) stickers will respectively qualify participants for the first, second, and third tier prize draws. After collecting stickers, participants should submit a form on the Festival website, along with a photo of their filled-out passport. For each tier, entrants can also enter by mail. To enter without collecting stickers, handwrite your full name, complete address, phone number, date of birth, and email address on a 3″ x 5″ card and mail it with sufficient postage to: Noms Magazine Foodie Festival Passport Sweepstakes, (provide mailing address), and indicate the tier you are entering for. All mail-in entries must be postmarked during the Sweepstakes period and received within five (5) days after the Sweepstakes period ends.

c) No Purchase Necessary Entry: Entrants may enter without making a purchase by hand-printing their full name, complete mailing address, phone number, and email address on a 3″ x 5″ card and mailing it in an envelope with proper postage to: Noms Magazine, [Floor 18 Wework, 450 SW Marine Dr Floor 18, Vancouver, BC V5X 0C3]. You will receive one (1) entry into the Sweepstakes per envelope.

6. Winner Selection and Notification

Winners will be selected in a random drawing under the supervision of the Sponsor. Winners will be notified via email within one (1) week following the winner selection.

7. Prize(s)

The exact prizes will be detailed on the Sweepstakes Mission and Passport page on the Noms Magazine Vancouver Cherry Blossom Food Festival website.

8. Compliance with Social Media Platforms Rules

This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram or TikTok. You understand that you are providing your information to the Sponsor and not to Instagram or TikTok. By participating via the Instagram or TikTok platform, participants are also subject to Instagram’s and TikTok’s privacy policies and terms of use, which can be found at www.instagram.com/about/legal/privacy/ and www.tiktok.com/legal/privacy-policy?, respectively.

9. Winner Announcement

The winners of the Sweepstakes will be posted on the official Noms Magazine Vancouver Cherry Blossom Food Festival website within two (2) weeks after the selection and verification process. Winners may be requested to provide a testimonial to be displayed in promotional materials or their address for retrieving their prize.

10. Sponsor’s Right to Modify or Terminate

Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, technical failures, or any other factor beyond Sponsor’s reasonable control corrupt the administration, security, fairness, integrity or proper operation of the Sweepstakes. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.

11. Limitation of Liability

By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the cancellation or postponement of the event, the incorrect downloading of the application, the processing of entries application downloads or in any Sweepstakes-related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize.

12. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in British Columbia.

Information collected from entrants is subject to sponsor’s privacy policy.
